1 : General

1.1 Domains registered byHellonetare reserved for the sole use of Hellonet and/or their Members. Hellonet reserves the right to alter, edit or remove, any registered domain at their sole discretion, without compromising services provided.

1.2Hellonet Servers may only be used for lawful purposes. Illegal or undesirable material will be removed without notice.

1.3Transmission, distribution and storage of data in violation of global laws, copyright, trademark or other lawful protection, is prohibited.

1.4User domains containing material deemed, "objectionable" - by Hellonet will be suspended or removed without prejudice. "Adult Content" web sites may be allowed, subject to escalated fees, and other conditions imposed by Hellonet.

1.5Hacking, phreaking, linking, or providing resources aimed at such activities are prohibited. Distribution of material containing viruses, spam, anarchy, or the promotion thereof is forbidden. Compromising the integrity of HelloNet and its Members are deemed unlawful and perpetrators will be prosecuted without notification or warning.

2  Abuse

2.1Unreasonably use of server resources will result in increased fees, or suspension. Hellonet will be the sole arbitrator of what is considered high usage levels.hellonet
2.2Illegal use of Hellonet servers will result in termination of services. Illegal material is defined as any written content banned under South Africa's Local, Provincial, State or Constitutional laws.

3.1Be considerate to other users! Internet activities overloading resources, result in reduced efficiency for all users. If in doubt, consult Hellonet for assistance ...

1  Privacy

1.1Hellonet shall take all possible and reasonable steps to protect personal User information recorded.

1.2Hellonet will collect and use, information like  -  name, birth date, ID or Passport numbers, gender, country of residence, city, non-personal browsing habits, click patterns, e-mail and IP addresses, for Client control records.

1.3Collected user information will never be disclosed to a third party without users consent. Information may be disclosed to legally authorized parties, if so ordered by due legal process.

1.4Hellonet hereby claims ownership, and rights to all non-personal, statistical information collected and compiled from user activity during the life of service agreements.

2  Intellectual Property Rights

2.1 Content, trademarks and data displayed and stored on Hellonet Servers, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and or agreements, are the property of; Or licensed to HelloNet and are protected from infringement by local and international legislation and treaties.


3  Electronic Communications

3.1Users visiting Hellonet domains, or electronically contact Hellonet at any time, consent to the receipt of email and telephonic communication from Hellonet.


4  Hyperlinks

4.1No person, business or web site may link to Hellonet domains without proper, written permission from Hellonet. To obtain permission - contact the Admin Manager (clause 1) above.

4.2Hyperlinks provided on Hellonet domains, are included as a service to Members. Hellonet may not necessarily agree with, or endorse content found on linked websites.


5  Disclaimer

5.1Apart from the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act; neither Hellonet nor any of its agents or representatives shall be liable for damage, loss or liability, of whatsoever nature arising from the use - or inability to use - services or content displayed on Hellonet domains and servers. Hellonet offers no warranties that said content are free from errors or omissions. Hellonet offers no warranties that services will be uninterrupted and error free 24/7. Users are encouraged to report such malfunctions or errors as indicated in clause1.1

5.2Hellonet websites are designed to please the greater majority. Clients should satisfy themselves prior to entering into any agreement with Hellonet, whether the available services meets with their requirements, and is compatible with their hard, and software.

5.3Information, ideas and opinions expressed on Hellonet domains should not be regarded as professional advice, or as the official opinion of Hellonet.

5.4Hellonet, their agents or representatives, shall not be liable for any damage, loss or liability arising from the use of products sold from their domains.

5.5Hellonet is not directly involved or contribute to Air time Vouchers sold from their domains. Hellonet are not liable for loss or damages suffered as a result thereof.


6  Cost of Sales

6.1The cost of products or services are displayed on Hellonet domains. Orders placed will be confirmed with descriptions and price. Users should report errors - refer to clause1.1.

6.2Value Added Tax (VAT) will be indicated and added separately on orders placed.

6.3Imported products or services, may incur additional or variable cost due to exchange rate variations. Such additional costs will be for the users account, and will be reflected on invoices submitted on or prior to delivery.


7 : Deliveries

7.1Products will indicates approximate delivery time where applicable.

7.2Products (other than electronic services) normally require from one to six weeks for delivery within South African borders.

7.3Website construction is dependent on the complexity of the design. Timely provision of content, graphics, and other client input, are paramount to a reasonable completion date. Hellonet will not accept responsibility for delays unless caused by non-performance by Hellonet.

7.4Design of websites, and other software, for clients outside South Africa will be quoted in US Dollars.


8  Cancellation and Non-Payment

8.1"once-off" or "recurring" services - may be paid by credit card - through foreign or locally offered service providers - such as "2checkout.com" and "Paypal" or others as displayed on Hellonet domains.
Payments may also be made directly, using electronic banking services, or by approved debit order arrangement - noting that additional bank charges incurred will be for the client's account. Payment by cheque (check) is not accepted.

8.2Monthly payments of internet services (where accepted in writing) are due on the first day of each calendar month.

Annual (or other periodic payments) are due on the first day of the calendar month when renewal becomes due.
All payments are due in advance, and prior to commencement of service.

Services not paid by "Due Date" - may be suspended as per clause 8.4 below.

The "first" - payment for a new service may include additional charges for domain registration and/or other agreed costs. Services will only be activated on receipt of the agreed fees, or by arrangement.

8.3Cancellation of service - is subject to a one calendar months notice in writing. Such a notice must be received by the 27th day of the previous month. The notice period will commence on the first day - and conclude on the last day of the following month. Full services will be provided during this period. Client domain(s) Transfer to another service provider, will be refused unless all outstanding fees owed to Hellonet have been paid.

8.4Payments not made on the first calendar day of the month due (as per clause 8.2 above) - Will result in a suspension of services - without prejudice. The date of suspension will be determined by HelloNet at their sole discretion, but will be preceded by a final request for immediate payment of arrears. Re-instatement of suspended services will require the payment in full, of all outstanding fees, plus a "reconnection" fee of R250.00 prior to continuation of service. Non payment of services will result in legal action by Hellonet to recover all outstanding fees (including legal). ...


9  Agreement of Sale

9.1An "Agreement of Sale" between Hellonet and a user takes effect on receipt of a deposit, first fee or full payment. All payments may include additional activation costs, as described in clause 8.2.

9.2Refunds of payments made in advance, may be repaid at the discretion of Hellonet. Such refunds will normally only be refused if the client was guilty of a misdemeanor, unacceptable conduct as listed on these pages - or for possible non-payment of other or additional services.


10  Domains - Fees and Ownership

10.1Hellonet defines a domain as: A named or titled space made available to a user, on the World Wide Web (WWW) - through various "Registrars" around the world - on written request from Hellonet. Such domains are created on the Hellonet servers being - the clients chosen Internet Service Provider (ISP).

10.2Annual Registration fees are payable to the registrar, and is usually made by Hellonet on behalf on behalf of the client. Clients may pay registration fees directly, but are then solely responsible for the maintenance of their domain.

10.3Hellonet list themselves as the "registrant" of all domains registered on behalf of clients unless hosting fees are paid annually in advance. For reasons and further information please contact the Admin Manager as listed under TERMS AND CONDITIONS - Clause1.1 above.


11  Governing Law

11.1Hellonet operates from within the Republic of South Africa, subject to South African law.

11.2Hellonet shall not be liable for costs incurred by clients seeking professional advice relating to these terms and conditions ...


12  Security

12.1Persons attempting delivery of damaging code to Hellonet domains; Or attempt to gain unauthorized access to pages on Hellonet websites; Shall be prosecuted and damages shall be claimed to recover losses suffered by Hellonet or their clients.

12.2-  Users undertake, and agree, that login names and passwords shall be for personal use only and securely protected. Users will be liable for damages caused to Hellonet severs if access is gained from the illegal use of access codes made available directly or indirectly to a third party.


13  Changes to Agreement

13.1HelloNet Services may, at its sole discretion, change this agreement or any part thereof at any time without prior notice ...


14  Disputes

14.1Unresolved disputes arising between Hellonet and users shall be submitted to confidential arbitration as agreed; Or by seeking a ruling via legal channels.


15  Domicilium

15.1Hellonet chooses as its domicilium citandi et executandi, for all purposes under this agreement, whether in respect of court processes, notices, or other documents or communication of whatsoever nature : Muldersbank, Volmoed, Oudtshoorn, Western Cape ...


16  Term and Termination

16.1This agreement shall be deemed to be in effect - when clients or users, register on any Hellonet domains. The agreement will continue indefinitely until terminated by Hellonet in the event of a breech of contract, or directly by the client or user upon termination of services. Or by either party, for any acceptable or legal reason.
